Us Weekly confirmed that Kennedy was arrested on Tuesday, December 10, after attending Kathy Hilton‘s Christmas party at her home in Los Angeles. According to the Burbank Police, officers responded to a call “regarding an argument between a man and a woman,” which was later deemed a “domestic incident.” Kennedy was taken into custody and booked for misdemeanor domestic violence before posting bail.

Attorneys for the Bravo personality addressed his arrest in a statement shared Friday, December 13. “We are in the process of conducting our own investigation into the allegations levied by the Burbank Police Department against James,” the statement read. “We understand that there were no injuries and we are hoping that, after careful review, the city’s attorneys will decide not to file formal charges.”

An eyewitness exclusively told Us that Kennedy “looked like he was in great spirits” at Hilton’s holiday celebration the night of his arrest, noting, “He seemed like he was in a good headspace and was dancing, singing and having fun.” A second insider, meanwhile, saw Kennedy “running” through the party and “causing a scene” with “erratic” behavior. A police report later revealed more details from the arrest, with an unidentified woman claiming Kennedy “lifted her up and threw her to the ground.” Lewber, 28, broke her silence on the situation via her Instagram Story on Saturday, December 14.
